Najib Razak Admits RM42 Million Was Not Saudi Donation: Full Court Hearing Analysis (2026)

Imagine being accused of a crime, vehemently denying it with a seemingly plausible explanation, only to later admit that explanation simply doesn't hold water. That's precisely what happened in the ongoing saga surrounding former Malaysian Prime Minister Najib Razak and the infamous RM42 million deposited into his personal accounts. He has now conceded in court that this money had absolutely nothing to do with a supposed donation from the Saudi royal family, a defense he previously used to explain the funds. But here's where it gets controversial...

This admission came during a cross-examination in a civil suit brought by SRC International and its subsidiary, Gandingan Mentari Sdn Bhd. These entities are attempting to recover what they allege are misappropriated funds, and the RM42 million is a key piece of the puzzle. SRC's lawyer, Kwan Will Sen, relentlessly questioned Najib, pressing him on whether he still believed the money came from Saudi Arabia.

Initially, Najib stated that "at that particular time, I thought it was a Saudi donation." However, when pressed to clarify if he now accepted the funds had no connection to any donation, he conceded, "Based on subsequent knowledge, yes." This "subsequent knowledge" is crucial, as it suggests a shift in his understanding of the source of the funds. And this is the part most people miss... the implications are far-reaching and strike at the heart of his defense.

The lawyer further reminded Najib that this very "Saudi donation" defense had already been rejected by multiple courts in the separate SRC criminal trial, the one that landed him in jail. "This particular defence of the Saudi donation was dismissed by all levels of the courts… is that a correct statement?" Kwan asked. Najib confirmed this, adding that he "didn’t have the opportunity to do a full explanation at the Federal Court," claiming that a senior judge in a subsequent review agreed he wasn’t afforded a fair trial. This claim could spark differing opinions. Was he truly denied a fair trial, or is this a last-ditch effort to cast doubt on the verdict?

Kwan, however, pointed out that the majority decision still upheld the finding that the RM42 million was not a donation. "All said and done… that is correct, isn’t it?" he asked. Najib's response? "Yes. Unfortunately, yes." This reluctant admission is a significant blow to his credibility.

But the story doesn't end there. The court also learned that in Najib's ongoing 1MDB trial, High Court judge Collin Lawrence Sequerah had similarly concluded that no documentary evidence supported the Saudi donation claim. Najib confirmed this, noting that he has lodged an appeal. So, we have multiple courts, in multiple trials, consistently rejecting this Saudi donation narrative.

As a reminder, Najib, now 72, is currently serving a six-year sentence at Kajang Prison, a sentence he began in August 2022 after his SRC conviction was upheld. His original 12-year prison sentence and RM210 million fine were halved by the Federal Territories Pardons Board in January 2024, a decision that sparked considerable public debate. Furthermore, in December of last year, Judge Sequerah sentenced Najib to an additional 15 years' imprisonment and imposed an RM11.387 billion fine in the 1MDB case, sentences to be served consecutively. This means he faces a considerable amount of time behind bars.

Najib was represented in court by lawyer Farhan Shafee. The hearing before Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan is scheduled to continue.
